Right of First Refusal (Transmission Service)

Definition

The contractual right of an existing firm transmission service customer to retain its capacity reservation when its contract expires or rolls over, provided it agrees to match any competing request in terms of duration (minimum five years) and pays the current just and reasonable rate. Under §2.2, the customer must notify the Transmission Provider at least one year before contract expiration whether it will exercise this right. If a competing request is longer-term or higher-priced, the existing customer must match it within 24 hours or lose priority to the new entrant.
