Definition

18 CFR Part 358 applies to any public utility that owns, operates, or controls facilities used for the transmission of electric energy in interstate commerce and conducts transmission transactions with an affiliate that engages in marketing functions. This triggers the full Standards of Conduct regime—independent functioning, no conduit, and transparency rules—to prevent discriminatory treatment of non-affiliated transmission customers.
