Definition

For Part 358, affiliate means another person that controls, is controlled by, or is under common control with the specified entity. An affiliate includes a division of the specified entity that operates as a functional unit. For exempt wholesale generators, the definition in § 366.1 applies. Control is defined separately, with a 10 percent voting interest creating a rebuttable presumption.
